THE FRANCHISE application of the Vietnam-based company Green and Smart Mobility (GSM) is still pending, the Land Transportation Franchising and Regulatory Board (LTFRB) XI said Friday.
Atty Deanne Aubrey Salcedo, LTFRB XI legal section assistant, said the application was hampered by the multiple petitions stopping GSM’s entry into the city.
“For the LTFRB, the application of GSM is still pending, considering there is nag-file nga opposition,” Salcedo said during the Kapihan sa PIA on Friday.
Salcedo added that other parties have the right to file an opposition against an application for a certificate of public convenience (CPC).
A CPC is an authorization issued by the LTFRB for the operation of land transportation services for public use.
Salcedo said the office received three oppositions from different personalities, from a certain individual, and from a group of taxi operators.
She clarified that there was no opposition from the local government, but the parties that filed have enumerated several grounds for their opposition.
“We will transmit it to the central office because if an application for CPC is opposed, the regional office will transmit it to the central office for resolution,” Salcedo said, adding that the documents have been transmitted to the Board En Banc in the second week of January.
The official clarified that the provisional authority will come from the central office, and the applicant will still undergo hearings for a regular CPC.
To note, the city government called on the Land Transportation Office (LTO) and the Land Transportation Franchising and Regulatory Board (LTFRB) to look into the operations of Green GSM Taxis following their launch on December 15.
The city government released a statement as the operator of Green GSM Taxis reportedly has yet to comply with all necessary permits from government agencies before operating within the City of Davao.
For instance, the company allegedly has not yet secured a business permit, locational clearance, and a building permit for its facilities.
