THE COMMISSION on Elections issued a Certificate of Finality and Entry of Judgment of the Order of the Commission En Banc, cancelling the registration of the Duterte Youth Party-list effective immediately.
In a ruling dated Aug. 29, the Commission En Banc resolved to deny the motion for reconsideration of the Duterte Youth Party-list and affirmed the resolution of the Comelec Second Division to cancel the party-list’s registration.
“The Commission En Banc iterated the decision of the Commission Second Division wherein it found that Duterte Youth Party-list’s registration is void ab initio for failure to comply with the publication and hearing requirements, which are jurisdictional in nature,” it said.
The grounds for the cancellation of its party registration, which includes untruthful statements in its Petition, particularly on the eligibility of its nominees; no bona fide intention to represent the sector for which the petition has been filed, preventing a faithful determination of the true will of the electorate.
Comelec also stressed that the party-list advocated violence or unlawful means to achieve its goal and was an adjunct of or an entity funded or assisted by the National Youth Commission.
It also violated or failed to comply with laws, rules or regulations relating to elections; and the petition has been filed to put the election process in mockery or disrepute.
“The withdrawal and substitution en masse, as well as the back-and-forth switching of DUTERTE YOUTH partylist nominees during the 2019 National and Local Elections, undermine the spirit and intent of the party-list system and put a mockery on the election process,” it added.
Meanwhile, in a Facebook post, the Duterte Youth slammed the Comelec for the resolution.
“Kaya nagiging kurakot ang mga pulitiko sa bansa, meron namemera sa simula pa lang e, need iareglo lagi, e tayo wala tayo pang areglo, di tayo nag negosyo sa gobyerno or nangurakot, tayo pa kaisa-isa sa Kongreso na nagbabalik ng Death Penalty para sa mga kurakot sa gobyerno,” it said.
“Magkano bayad nung tatlong talo na mabibigyan ng 3 Congress Seats? Putanginang Bulok na Marcos Admin to!” it added.
With the ruling, the Comelec will tackle the redistribution of three seats won by the Duterte Youth.
